"We," "us," and "our" refer to Concord Wholesale, the official licensed source for Tapatío® salsa, sriracha, and chili crisp, which operates this store (the "Services") using the Shopify platform. These Terms of Service, together with our Privacy Policy, govern your use of the Services. By using the Services, you agree to these Terms; if you don't agree, please don't use the Site.

1. Account & Access

You must be at least the age of majority in your state to use the Services. Information you provide (email, billing, shipping, payment) must be accurate and current. You're responsible for your account's security and activity.

2. Products, Pricing & Orders

We try to accurately represent our products, but actual color or appearance may vary by device. Product details, pricing, and availability may change at any time without notice, including after you've placed an order, and we may correct errors, limit quantities, or discontinue products at our discretion. Placing an order is an offer to purchase; we may accept, decline, or cancel any order, and it isn't final until we confirm it and process payment. Prices don't include taxes, shipping, or handling unless stated. Retail purchases are intended for personal or household use, not resale. Wholesale and business accounts, which may purchase for resale, are subject to separate terms confirmed at the time of the order. Returns and exchanges follow our Return & Refund Policy.

3. Shipping

Shipping timelines and costs are described in our Shipping Policy. Delivery estimates are not guaranteed; we're not liable for delays caused by carriers or events outside our control. Risk of loss passes to you once an order is handed to the carrier.

4. Intellectual Property

All content on the Services — including trademarks, text, images, and designs — belongs to Concord Wholesale, its affiliates, or licensors, and is protected by copyright and trademark law. Tapatío® and related marks are used under license from their owner. You may use the Services for personal, non-commercial use only, and may not copy, reproduce, or redistribute our content without written permission.

5. Third-Party Tools, Links & Feedback

The Services may include tools or links provided by third parties, which we don't control and aren't responsible for — use them at your own risk. If you submit feedback, reviews, or suggestions, you grant us a free, worldwide, perpetual license to use them for any purpose, and you're responsible for making sure your submissions don't violate anyone's rights or the law.

6. Relationship with Shopify

Concord Wholesale is powered by Shopify, which enables us to provide the Services. Any purchases you make are made directly with Concord Wholesale, not Shopify. Shopify is not responsible for any aspect of transactions between you and us, including any resulting injury, damage, or loss, and you release Shopify and its affiliates from any related claims.

7. Privacy & Automated Access

Your personal information is handled under our Privacy Policy, and, because the Services run on Shopify, some information is also processed under Shopify's Privacy Policy. Automated tools, bots, or AI agents may not access or interact with the Services unless they clearly identify themselves as such and comply with any access controls we put in place.

TO THE FULLEST EXTENT PERMITTED BY LAW, CONCORD WHOLESALE, SHOPIFY, AND THEIR RESPECTIVE AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM. You agree to indemnify and hold us harmless from any claims arising from your breach of these Terms or misuse of the Services.

10. General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, along with our other policies, are the entire agreement between you and us and replace any prior agreements. These Terms are governed by the laws of the State of California, and any disputes will be handled in California courts.
